Anaplan Academy Terms of Use 

Unless otherwise stated, the contents and all associated materials provided to you as part of your participation in the Program are the property of Anaplan. All trademarks used or referred to in the Program are the property of their respective owners. Nothing contained or provided to you as part of your participation in this Program shall be construed as conferring by implication or otherwise, any license or right to any copyright, patent, trademark or other proprietary interest of Anaplan or any third-party. 

 

The information provided to you during your participation in the Program is for informational purposes only and does not create a business or professional services relationship between you and Anaplan. The Program is provided to you “as is” and Anaplan makes no representation or warranty of any kind with respect to the Program. Anaplan expressly disclaims all express and implied warranties including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.  In no event will Anaplan be liable to any party for any direct, indirect, incidental, special, exemplary, consequential, or other damages (including, but not limited to, lost profits, business interruption, loss of programs or data) without regard to the form of action and whether in contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with your participation in the Program. 

 

You agree that these terms of use and any legal action or proceeding relating to the program shall be governed by the laws of the State of California without reference to its choice of law rules. If you attempt to bring any legal proceedings against Anaplan, you specifically acknowledge that Anaplan is free to choose the jurisdiction of our preference as to where such action against us may be held.  

 

Unless expressly stated otherwise herein, any information submitted by you as part of your participation in the Program shall be deemed non-confidential and non-proprietary. You represent that you have the lawful right to submit such information and agree that you will not submit any information unless you are legally entitled to do so. 

 

Use of the Anaplan Service 

 

In exchange for Anaplan granting me a non-exclusive, non-sublicensable, nontransferable, revocable right to access and use Anaplan's hosted service (the "Anaplan Service") as part of my participation in the Program, I agree: 

I will not: (a) commercially exploit the Anaplan Service; (b) modify or create derivative works based on the Anaplan Service; (c) reverse engineer or access the Anaplan Service in order to build a product using features, functions or graphics similar to it; (d) copy any features, functions or graphics of the Anaplan Service; (e) allow access rights to the Anaplan Service to be shared or used by anyone other than me; (f) send or store any messages or material that are known to be unlawful or infringing using the Anaplan Service; (g) interfere with or disrupt the integrity or performance of the Anaplan Service; or (h) use the Ana plan Service for any commercial or productive business purpose; 

 

I recognize that (a) Anaplan owns and will continue to own all right, title and interest, including all related intellectual property rights, in and to the Anaplan Service and any Anaplan Applications; (b) anything I create within the Anaplan Service will be owned by Anaplan; and (c) Anaplan will be free to incorporate, use, and commercialize any suggestions, recommendations or other feedback I may make about the Anaplan Service 

 

To keep confidential any information disclosed to me by Anaplan or that I discover through my access to and use of the Anaplan Service, including but not limited to technical information and any other non-public, proprietary information 

 

That my access to the Anaplan Service is provided "AS IS"' WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL ANAPLAN BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF MY USE OF THE ANAPLAN SERVICE
